Legal investigators specialize in cases involving the courts and are normally employed by law firms. They frequently assist in preparing criminal defenses, locating witnesses, serving legal documents, interviewing police and prospective witnesses, as well as gathering and reviewing evidence. Legal investigators also may collect information on the parties to the litigation, take photographs, testify in court, and assemble evidence and reports for trials.

Most detectives and investigators are trained to perform physical surveillance, often for long periods, in a car or van, while stationary or on the move, until the desired evidence is obtained. They may observe a site, such as the home or business of a subject, from an inconspicuous location. The surveillance may involve using still and video cameras, binoculars, cell phones and computers.

In cases for employers that involve fraudulent workers’ compensation claims, investigators may carry out long-term covert observation of subjects. This could be combined with the interviewing of likely witnesses such as neighbors, coworkers or relatives. If covert surveillance is warranted and an investigator observes a subject performing an activity that contradicts, or tends to confirm injuries stated in a worker’s compensation claim, the investigator would take video or still photographs to document the activity and report it to the client.

Information obtained from this phase of a background check is used to help answer, confirm or guide you to the next step in a complete investigation of a subject or suspect's background.
